Evolución de la tenencia de la tierra en la Parroquia El Junquito, municipio Libertador. Distrito Capital
La Parroquia El Junquito del Municipio Libertador del Distrito Capital localizada en el área montañosa del sector oeste del mismo, fundada en el año 1987 con territorios de las Parroquias Antímano y Sucre, como zona de expansión urbana de Caracas presenta un rápido crecimiento de población asociado a un proceso continuo de división de inmuebles históricos, mediante parcelamientos y ventas de lotes a través de documentos protocolizados ante el Registro Inmobiliario, o documentos autenticados ante Notaría Pública. Igualmente se aprecia un proceso de ocupación de tierras para construcción de viviendas, cuyos pisatarios carecen de títulos, lo cual ha creado una compleja situación de indefensión legal en cuanto a la tenencia de la tierra. Por otra parte, se ha constatado la existencia de títulos de propiedad dudosos de “terratenientes” cuya cabida y linderos se superponen con otros inmuebles de vieja data, lo cual ha generado inseguridad jurídica a los compradores de lotes, y controversias legales con propietarios e instituciones que disponen de títulos consistentes. Recientemente las autoridades gubernamentales han desarrollado una política de titulación a los poseedores de lotes en asentamientos urbanos populares, situados en terrenos públicos. La presente investigación pretende sintetizar el proceso descrito, planteando las soluciones de orden jurídico que permitan resolver los conflictos y circunstancias que afectan a los habitantes de la Parroquia El Junquito en cuanto a la propiedad y posesión de terrenos que habitan.AbstractThe parish El Junquito the Libertador Municipality of the Capital District, located in the mountainous area of the western sector of the same, founded in the year 1987 with territories of the parish Antímano and parish Sucre, as a zone of urban expansion of Caracas, presents a rapid population growth, associated with a continuous process of division of historical buildings, by parceling and sales of lots through documents protocolized before Real Estate Registry, and authenticated documents before Notary Public. It also appreciates a process of occupation of land for construction of dwellings, whose pisatarios lack title, this has created a complexsituation that is legally in the land tenure. On the other hand hit has been found the presence of property titles of “landowners” whose scope and boundaries overlap with other buildings of old data, which has generated legal uncer tainty to the buyers of lots,and legal disputes with owners and institutions that have titles of consistent. Recently the government authorities have developed a policy of diploma-holders of lots in popular urban settlements, situated on public land. The present investigation aims to synthesize the process described, raising and circumstances affecting the inhabitants of the parish El Junquito with regard to the ownership and possession of the land they inhabit.
