Performance of the Environmental Impact Assessment System (SEIA) at channeling indigenous consultation of the ILO Convention 169
Starting from a jurisprudential development, a regulatory criterion has been adopted to canalize the indigenous consultation regarding investment projects (a State duty under the Convention concerning Indigenous and Tribal Peoples in Independent Countries of the ILO, C169) through the environmental impact assessment system (SEIA). The article reviews, by analyzing doctrine and available administrative precedents, the efficiency of indigenous consulting procedures in the SEIA. Considering as main obstacles the timing of the indigenous consultation; the equivalence of significantly adverse impacts with the susceptibility of indigenous affectation; and the finality of both procedures, the analysis evaluates fulfillment of the requirements of good faith, of reaching agreement or consent, and appropriate procedures. The article concludes that the SEIA has specific and relevant particularities that hinder an efficient indigenous consulting. For this reason, it is so necessary improve regulatory framework or review the permanence of indigenous consulting within the SEIA.
